Terms of Service

Last updated:

These Terms of Service (“Terms”) are a legally binding agreement between you and MyTruckk.com Solutions Private Limited (“MyTruckk”, “we”, “us”) governing your use of the MyTruckk (shipper app), the MyTruckk Move (driver app), this website and related services (together, the “Platform”). They are an electronic record under the Information Technology Act, 2000 and do not require a physical or digital signature. Please read them together with our Privacy Policy and our Refund & Cancellation Policy, which form part of these Terms.

1. Acceptance and eligibility

By creating an account, posting a load, submitting a quote or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

  • You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
  • The Platform is for individuals and businesses in India moving goods within India. If you use the Platform for a business, you confirm that you are authorised to bind that business, and “you” includes that business.
  • You must not use the Platform if we have previously suspended or removed your account, unless we agree in writing.

2. What MyTruckk does — and does not do

MyTruckk is an online marketplace. It lets shippers post loads that need to be moved, lets truck owners and fleet operators (“carriers”) quote to carry them, and provides tools for booking, trip tracking, delivery confirmation, payment escrow and payouts.

MyTruckk is not a transporter, carrier, goods transport agency, consignor, consignee or freight forwarder, and does not take possession of, or title to, any goods. The contract for carriage of goods is made directly between the shipper and the carrier whose quote the shipper accepts. The carrier is solely responsible for performing the transport, and the shipper is solely responsible for the goods and their description. We are not a party to that contract, except for our role in holding and releasing payments as described in Section 7.

MyTruckk acts as an “intermediary” within the meaning of Section 2(1)(w) of the Information Technology Act, 2000 for information that users publish on the Platform (such as load details, quotes, reviews and photos), and observes the due diligence required by the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

3. Accounts, verification and KYC

  • You must give accurate, current and complete information when you register and keep it up to date. You are responsible for everything that happens under your account and for keeping your password and one-time passwords confidential.
  • Before you can post loads or submit quotes, you must upload the documents we ask for and have them approved by our verification team. Depending on your role these include a PAN card (shippers), a driving licence (drivers) and the registration certificate (RC) and insurance for each truck. We may ask for other documents, such as GSTIN, fitness certificates or permits, at any time.
  • To receive payouts, truck and fleet owners must complete payout setup with bank account, PAN and related KYC details, which are verified by us and our payment partner, Razorpay.
  • Approval of a document means only that it appeared valid to us when reviewed. It is not a guarantee of any user’s identity, licences, conduct or ability to perform. You remain responsible for making your own checks before dealing with another user.
  • Truck and fleet owners may invite drivers and authorise agents to act for them on the Platform (for example to quote, assign drivers or manage trucks). The owner is responsible for everything their drivers and agents do on the Platform.

4. Your obligations

4.1 Shippers

  • Describe each load accurately and completely, including cargo type, weight, dimensions, special handling needs (such as fragile, hazardous, refrigerated, oversized or livestock), pickup and drop-off details and receiver contact.
  • Ensure the goods are lawful, properly packed, labelled and loaded, and accompanied by all documents required by law, such as invoices, e-way bills and permits.
  • Ensure someone is available at pickup and delivery to hand over and receive the goods and to share the one-time code used to confirm pickup and delivery.
  • Keep enough balance in your wallet to pay for quotes you accept.

4.2 Truck owners, fleet owners and drivers

  • Hold and keep valid all licences, registrations, permits, fitness certificates, insurance and tax registrations required to operate your trucks and carry the goods you quote for.
  • Only quote for loads you can carry with a roadworthy truck of suitable type and capacity, and confirm accepted bookings within 2 hours.
  • Collect, carry and deliver the goods with due care, by the agreed time, following all traffic, motor vehicle, weight and safety laws, and without sub-contracting the trip to anyone outside your fleet without the shipper’s consent.
  • Record trip milestones truthfully, including the pickup and delivery one-time codes and photos the app asks for. You must not mark a load as picked up or delivered when it has not been.
  • Drivers must hold a valid driving licence for the vehicle, must not drive under the influence of alcohol or drugs, and must not carry passengers or additional goods that are not part of the booking.

5. Prohibited goods and conduct

5.1 Prohibited goods

You must not post, quote for or carry:

  • goods whose possession, sale or transport is illegal in India or in any state the trip passes through, including narcotic drugs and psychotropic substances, arms, ammunition and explosives, counterfeit or stolen goods, and wildlife or wildlife products protected by law;
  • hazardous or dangerous goods (such as flammable, toxic, corrosive or radioactive materials or gases) unless they are correctly declared as hazardous on the load, and the carrier, vehicle and driver hold every licence and meet every requirement under the Central Motor Vehicles Rules, 1989 and other applicable law;
  • livestock or perishable goods unless they are declared as such and transported in compliance with applicable animal welfare and food safety laws;
  • cash, bullion, jewellery, securities or other high-value items of a similar nature;
  • goods that require documents (such as e-way bills or permits) that have not been issued;
  • any other goods listed in [ADDITIONAL PROHIBITED GOODS LIST, IF ANY].

5.2 Prohibited conduct

In line with Rule 3(1)(b) of the Intermediary Guidelines, you must not host, display, upload, publish, transmit or share any information on the Platform that:

  • belongs to another person and to which you have no right;
  • is obscene, pornographic, paedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relating to or encouraging money laundering or gambling, or promoting enmity between groups on the grounds of religion or caste with intent to incite violence;
  • is harmful to children;
  • infringes any patent, trademark, copyright or other proprietary rights;
  • deceives or misleads about its origin, or knowingly and intentionally communicates misinformation or information that is patently false or untrue;
  • impersonates another person;
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to any cognisable offence, or prevents investigation of any offence, or is insulting to any other nation;
  • contains software viruses or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
  • violates any law for the time being in force.

You also must not:

  • arrange or pay for a load you found on the Platform outside the Platform to avoid our fees or escrow;
  • post fake loads or quotes, manipulate ratings, or create multiple accounts to evade a suspension;
  • share one-time codes with anyone other than the intended person, or falsify photos, locations or milestones;
  • scrape, reverse engineer, overload or interfere with the Platform, or access it other than through our apps, website or interfaces we provide.

6. Loads, quotes and the trip lifecycle

  • Posting a load. A shipper posts a load with its details, optional price range and pickup window. We notify nearby carriers and list the load on our load board.
  • Quotes. Verified carriers submit a quote with a price and the truck they will use, and may propose a different pickup window. A carrier may withdraw a quote until the shipper accepts it. Each quote is an offer to carry the load on those terms.
  • Acceptance. Each quote shows the carrier’s charge and an automatically calculated fuel charge; together they are the quoted price, so fuel is part of the carrier’s quote and is never added on top. When the shipper accepts a quote, exactly the quoted price is moved from the shipper’s wallet into escrow, and the carrier must confirm the booking within 2 hours. Once the carrier confirms, a binding contract of carriage exists between the shipper and the carrier. If the carrier does not confirm in time, the booking lapses, the escrowed amount returns to the shipper’s wallet and the load is reopened.
  • Trip. The carrier may start the trip from 24 hours before the pickup window. Pickup is confirmed with a one-time code and a photo of the goods. Delivery is confirmed with a one-time code given to the receiver (or the shipper) and photos of the goods on arrival and of the empty truck.
  • Completion. A booking is completed when the dispute window closes with no dispute raised, 48 hours after the carrier marks the load delivered. If a dispute is raised, the booking is completed when we resolve it.

7. Payments, escrow, fees and payouts

  • Payment partner. Payments are processed by Razorpay Software Private Limited. By paying through the Platform you also agree to Razorpay’s terms. We do not store your full card details.
  • Shipper wallet. Shippers pay by topping up a prepaid MyTruckk wallet. Wallet balances do not earn interest, are not a bank deposit, and may be used only to pay for bookings on the Platform. Refunds of unused balance are handled under the Refund & Cancellation Policy.
  • Escrow. You authorise us to hold the escrowed amount for a booking on your behalf and to release it to the carrier on completion, refund it to the shipper, or split it as described in these Terms and the Refund & Cancellation Policy. Escrowed amounts are held in [ESCROW / NODAL ACCOUNT ARRANGEMENT].
  • Fuel advance. Where available, after a trip starts the truck owner may receive the fuel part of the quote early as a fuel advance. It is deducted from the carrier’s final payout. If no advance is taken, the fuel part is paid with the trip payment.
  • Platform fee. We charge carriers a commission of [PLATFORM FEE %] of the full quoted price, including the fuel charge, deducted from the payout. Shippers do not pay a separate platform fee. Fees are exclusive of applicable taxes unless stated otherwise. We may change our fees on notice; changes do not apply to bookings already accepted.
  • Payouts. On completion, the carrier’s share (the escrowed amount less any fuel advance already paid and our commission) is credited to the truck owner’s wallet and paid to the verified bank account on file [PAYOUT SCHEDULE, e.g. daily / weekly]. Payouts may be held while KYC is incomplete, a dispute is open, or we suspect fraud.
  • Taxes. Each user is responsible for their own taxes, including GST and income tax on amounts they charge or receive, and for issuing any tax invoice or consignment note required by law for the transport service. [GST INVOICING FOR PLATFORM FEE]
  • Set-off. We may deduct from a user’s wallet or future payouts any amount that user owes on the Platform, such as a fuel advance that must be recovered after a dispute.

8. Cancellations, disputes and refunds

A shipper can cancel a load in the app while it is still open for quotes. After a quote is accepted, cancellations are handled by our team. If a delivery goes wrong, the shipper or the carrier can raise a dispute in the app before the booking completes; escrowed money is then held until we decide whether to release it, refund it or split it. Full details, including refund methods and timelines, are in our Refund & Cancellation Policy.

Our decision on releasing escrowed money is final as regards the Platform, but it does not decide legal liability between the shipper and the carrier and does not prevent either of them from pursuing their legal remedies against the other.

9. Goods in transit and insurance

  • Responsibility for loss of, damage to or delay of goods in transit lies between the shipper and the carrier under their contract and applicable law, including the Carriage by Road Act, 2007 where it applies. MyTruckk is not liable for goods in transit.
  • The Platform does not record the value of goods and MyTruckk does not provide goods-in-transit insurance. Shippers are responsible for insuring their goods for their full value. Carriers must hold the motor insurance required by law and any other cover they need for their operations.

10. Ratings, reviews and your content

  • After a booking is completed, the shipper and the carrier can rate and review each other. Ratings and reviews may be shown to other users. They must be honest, based on the actual trip, and comply with Section 5.
  • You keep ownership of the content you submit (such as load details, photos, documents, reviews and support messages). You grant MyTruckk a non-exclusive, royalty-free, worldwide, transferable licence to host, store, use, reproduce, display and share that content as needed to operate, secure and improve the Platform, resolve disputes and comply with law, for as long as we have a legitimate reason to keep it.
  • We do not pre-screen user content, but we may remove or disable access to any content that breaches these Terms or the law, including when we receive actual knowledge under Rule 3(1)(d) of the Intermediary Guidelines.

11. Location tracking during trips

To show shippers where their goods are, the driver app collects the assigned driver’s precise location while a trip is in progress, including in the background, and shares it with the shipper for that booking and with the truck owner. By accepting a booking, carriers agree to keep location sharing on until delivery. Details are in our Privacy Policy.

12. Suspension and termination

  • We may suspend, restrict or terminate your account, remove a load or quote, or withhold a payout, with or without notice, if we reasonably believe you have breached these Terms or the law, provided false information or documents, created risk for other users, or if required by a court or authority.
  • If we suspend a shipper, their open and accepted loads may be cancelled. If we suspend a carrier, their accepted bookings may be cancelled or, where a trip is already under way, allowed to finish. Escrowed money for cancelled bookings is handled under the Refund & Cancellation Policy.
  • If you believe your account was suspended in error, contact us at hello@mytruckk.com.
  • Sections that by their nature should survive termination (including payments owed, licences to content, disclaimers, limitation of liability, indemnity, and governing law) survive.

13. Closing your account

You can ask us to close and delete your account by emailing hello@mytruckk.com from your registered email address, as described in our Privacy Policy. Any trip in progress must be completed or cancelled and any open dispute, escrow, wallet balance or payout settled first. Closing your account does not affect rights and obligations that arose before it was closed.

14. Intellectual property

The Platform, including its software, design, text, graphics, logos and the MyTruckk name and marks, is owned by or licensed to MyTruckk.com Solutions Private Limited and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the apps and website for their intended purpose under these Terms. You may not copy, modify, distribute, sell or create derivative works from any part of the Platform without our written permission.

15. Disclaimers

The Platform is provided “as is” and “as available”. To the extent permitted by law, we make no warranty that the Platform will be uninterrupted, error-free or secure, that any load will receive quotes or any quote will be accepted, or that location, route, distance or arrival-time information is accurate. We do not guarantee the identity, quality, safety, legality or conduct of any user, the condition of any truck, or the description or legality of any goods.

16. Limitation of liability

To the extent permitted by law: (a) MyTruckk is not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, goodwill or data; (b) MyTruckk is not liable for loss of, damage to or delay of goods, or for the acts or omissions of any shipper, carrier, driver, agent or receiver; and (c) our total liability to you for any claim arising out of or relating to the Platform or these Terms is limited to the higher of the platform fees we earned from the booking giving rise to the claim and [LIABILITY CAP AMOUNT IN ₹]. Nothing in these Terms limits liability that cannot be limited under Indian law, including for fraud.

17. Indemnity

You agree to indemnify and hold harmless MyTruckk, its directors, officers, employees and agents from any claim, loss, liability, penalty, cost or expense (including reasonable legal fees) arising from your breach of these Terms or the law, the goods you ship or carry, your performance or non-performance of a booking, the content you submit, or the acts of your drivers and agents.

18. Force majeure

Neither MyTruckk nor any user is liable for failure or delay caused by events beyond their reasonable control, including natural disasters, floods, epidemics, war, riots, strikes, road or border closures, government orders, and failures of power, telecommunications, payment networks or third-party services. The affected party must notify the other promptly. Escrowed money for a booking that cannot be performed due to such an event is handled under the Refund & Cancellation Policy.

19. Governing law, jurisdiction and dispute resolution

  • These Terms are governed by the laws of India.
  • If you have a dispute with MyTruckk, please first contact us at hello@mytruckk.com or our Grievance Officer (Section 21). We will try to resolve it amicably within 30 days.
  • Any dispute between you and MyTruckk that is not resolved amicably shall be referred to arbitration by a sole arbitrator appointed by mutual agreement of the parties, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be [JURISDICTION CITY], and the proceedings shall be in English.
  • Subject to the above, the courts at [JURISDICTION CITY] have exclusive jurisdiction. Nothing here limits any non-waivable right you have as a consumer under the Consumer Protection Act, 2019.
  • Disputes between a shipper and a carrier about the carriage of goods are between them; we may help through the in-app dispute process but are not a party to them.

20. Changes to these Terms

We may update these Terms from time to time. We will change the “Last updated” date above and, for significant changes, notify you in the apps or by email before they take effect. If you keep using the Platform after the changes take effect, you accept the updated Terms. Changes do not affect bookings already accepted.
